Resumen
Los derechos humanos, considerados como una estructura normativa para la salvaguarda de la dignidad humana, en sus aspectos políticos, socioeconómicos y culturales, en el mundo de hoy necesitan reconfigurarse ante una Inteligencia Artificial IA, capaz de manejar procesos complejos y, a la vez, acelerar la toma de decisiones a gran escala, con riesgos significativos de degradación de la autonomía personal, si no se implementan protecciones específicas en el marco del derecho civil. Ante estas preocupaciones, el objetivo de la investigación consiste en discutir –críticamente– la situación general de los derechos humanos en la era de la IA, con énfasis en la regulación civil frente al dilema de la pérdida de puestos de trabajo en Europa en el periodo (2020-2030), articulando en la reflexión conceptos como dignidad humana, gobernanza del riesgo y derecho civil. Mediante el uso de metodología próxima a la hermenéutica jurídica, la mayéutica socrática y la técnica de investigación documental, pudimos concluir que, en el ámbito laboral, el péndulo se mueve entre la ilusión de un aumento significativo en la productividad y el peligro del empeoramiento de las condiciones laborales; sin embargo, la evidencia documental mencionada en este estudio sugiere cambios en las funciones más que una crisis de sustituciones.
