Resumen
Esta investigación examinó el parlamentarismo como filosofía jurídica, centrándose en sus fundamentos conceptuales y su evolución en los sistemas políticos contemporáneos. El estudio empleó una combinación de métodos de análisis histórico-jurídico, comparativo y sistemático para analizar las prácticas parlamentarias en múltiples jurisdicciones. Los resultados revelaron que el parlamentarismo como filosofía jurídica va más allá de los marcos procedimentales. La investigación identificó tres tradiciones filosóficas distintas que influyen en los sistemas parlamentarios modernos: los enfoques liberal-representativo, deliberativo-consensual y basado en la soberanía. La transición de Armenia a una república parlamentaria proporcionó una valiosa perspectiva sobre cómo las democracias emergentes adaptan los principios filosóficos dentro de contextos históricos únicos. El estudio reveló además correlaciones significativas entre los enfoques filosóficos y los patrones de razonamiento judicial en comparación con los de las tradiciones liberal-representativas. El estudio concluyó que reconocer el parlamentarismo como una filosofía jurídica integral, en lugar de un mero acuerdo procedimental, crea instituciones democráticas más resilientes. Esta investigación contribuye a la teoría jurídica al reposicionar el parlamentarismo dentro de la jurisprudencia constitucional como una filosofía fundamental, en lugar de un simple marco institucional.
