Resumen
La corrupción en el desarrollo de infraestructuras, especialmente en los proyectos estratégicos nacionales (PSN), sigue siendo un desafío importante en Indonesia, con un aumento notable de casos en el sector del transporte. Indonesian Corruption Watch (ICW) informó un aumento del 50 % en los casos de corrupción entre 2015 y 2018, con miles de millones de rupias perdidos debido a prácticas fraudulentas en los proyectos de infraestructura. El artículo subraya la necesidad de medidas más proactivas, especialmente acciones preventivas, para abordar de manera efectiva la corrupción en los proyectos PSN. Aunque los esfuerzos judiciales para abordar la corrupción, como la creación del Tim Pengawal dan Pengaman Pemerintahan dan Pembangunan (TP4), han dado algunos resultados, posteriormente fueron revocados debido a ineficiencias. Esta investigación aboga por un enfoque integral, que integre medidas preventivas y punitivas, liderado por la Fiscalía General de la República (AGO), para proteger los recursos públicos y mantener la integridad de los proyectos nacionales estratégicos. A través de un método de investigación doctrinal, el estudio evalúa críticamente el papel de la AGO, proponiendo una estrategia más robusta e inclusiva que equilibre la aplicación de la ley y las iniciativas preventivas. Además, el artículo explora el concepto de ultimum remedium, subrayando que las sanciones penales deben ser el último recurso después de que se hayan agotado todas las vías preventivas. En última instancia, la investigación subraya la necesidad de una revisión sistemática, fortaleciendo los marcos institucionales y promoviendo una gobernanza transparente para mitigar el costo social de la corrupción y apoyar el desarrollo sostenible de la infraestructura de Indonesia.
