Resumen

La ejecución de las políticas de rehabilitación para prisioneros transgénero y transexuales dentro del sistema de justicia penal indonesio requiere una consideración cuidadosa desde el punto de vista de los derechos humanos. Aunque la Ley No. 22 de 2022 sobre Correcciones describe de manera general las políticas de rehabilitación para los delincuentes, su implementación no ha abordado de manera efectiva las necesidades únicas de las personas transgénero. El marco legal en Indonesia, basado en un paradigma de género binario, con frecuencia da lugar a prácticas discriminatorias y al descuido de los derechos transgénero durante la rehabilitación en las instalaciones correccionales. La asignación de prisioneros transgénero basada exclusivamente en el sexo biológico, sin tener en cuenta su identidad de género, puede generar angustia psicológica y aumentar la probabilidad de violencia. Esto subraya la necesidad de reformas en las políticas penitenciarias que sean más inclusivas y basadas en los derechos humanos, asegurando un entorno seguro para que las personas transgénero expresen su identidad de género sin discriminación ni violencia. Las políticas correccionales deben incorporar evaluaciones de riesgos que consideren la identidad de género y asegurar la disponibilidad de instalaciones que faciliten la rehabilitación, incluidos los servicios de salud sensibles al género y el apoyo psicológico. La implementación de estas reformas tiene como objetivo facilitar el logro de los objetivos de rehabilitación y garantizar el trato equitativo de los prisioneros transgénero según sus derechos humanos.
