Resumen

El objetivo de este estudio fue evaluar en qué medida el sistema de justicia juvenil de Mongolia se ajusta a las normas internacionales en materia de protección de los derechos del niño. La metodología se basó en un análisis cualitativo de una amplia gama de fuentes documentales, entre ellas la legislación mongola, las normas internacionales y los informes pertinentes de organizaciones internacionales y nacionales entre 2020 y 2025. La investigación empleó métodos de investigación teórica, análisis jurídico comparativo y análisis documental. Se constató que, a pesar de los considerables avances en la armonización de la legislación nacional con las normas internacionales, especialmente desde 2016-2017, sigue existiendo una brecha significativa entre las disposiciones legales y su aplicación práctica. El estudio identificó una eficacia limitada del sistema debido a la falta crónica de financiación, la escasez de personal cualificado, la débil coordinación entre organismos y la aplicación inconsistente del principio del interés superior del niño.
